1. Scope
These Terms of Service ("Terms") govern your use of the Decision Altitude website and the purchase of digital products and advisory services offered by Artur Fortuna, operating as Decision Altitude ("we", "us", "our").
By accessing our website, purchasing products, or engaging our services, you agree to these Terms. If you do not agree, please do not use our website or services.
2. Nature of Services
Decision Altitude provides independent aviation mentorship and career advisory services. Our services include, but are not limited to:
- Pre-Training Clarity Sessions
- Flight School Vetting
- SIM Check & OPC Preparation
- CRM & Non-Technical Skills Development
- Written Career Decision Reports
- Self-paced digital guides and interactive resources
Important: Our services constitute independent guidance and mentorship based on professional aviation experience. We are not a flight school, Approved Training Organisation (ATO), or provider of certified flight training. Our advice does not replace certified instruction, regulatory guidance, or professional legal or financial advice.
3. Digital Products
3.1 Purchase and Delivery
When you purchase a digital product (e.g., Career Decision Guide), you receive the PDF via email upon successful payment. Each purchase also includes a personal license key for accessing the interactive guide on our website.
3.2 Pricing and VAT
All prices displayed are in Euros (EUR). Digital product prices are inclusive of applicable taxes, calculated and collected by our payment processor (Paddle.com, operated by Paddle Payments Ltd), which acts as the Merchant of Record for digital product sales.
3.3 License
Upon purchase, you receive a personal, non-transferable, non-exclusive license to access and use the digital product for your own private, non-commercial purposes. You may not copy, distribute, resell, share, or make the content available to third parties. Each purchase includes a personal license key for accessing interactive content on our website. License keys are non-transferable and intended for individual use only.
4. Right of Withdrawal (EU Consumers)
Under the EU Consumer Rights Directive (Directive 2011/83/EU), you have the right to withdraw from a purchase of digital content within 14 days of the purchase date, without giving any reason.
4.1 Exception for Digital Content
If you access the digital content immediately upon purchase (e.g., by starting the interactive guide or downloading the PDF), you acknowledge that you lose your right of withdrawal once the download or streaming of the digital content has begun, provided that:
- You gave your prior express consent to begin performance before the end of the withdrawal period; and
- You acknowledged that you would lose your right of withdrawal.
4.2 How to Exercise Your Right of Withdrawal
To exercise your right of withdrawal, send a clear statement (e.g., an email) to info@decisionaltitude.co stating your decision to withdraw. You may use the following template:
"I hereby give notice that I withdraw from my contract for the purchase of the following digital product: [product name], ordered on [date], by [your name], [your email address]."
Upon valid withdrawal, we will reimburse all payments received from you within 14 days using the same payment method used for the original transaction.
4.3 Advisory Services
For advisory sessions (e.g., Pre-Training Clarity Sessions, Flight School Vetting), the 14-day withdrawal period applies. However, if the service is fully performed within the withdrawal period with your prior express consent, the right of withdrawal expires upon full performance of the service.
Cancellation of scheduled sessions requires at least 48 hours' notice. Sessions cancelled with less than 48 hours' notice may be charged in full.
5. Refund Policy
We offer a 30-day money-back guarantee on all digital product purchases. If you are not satisfied with your purchase for any reason, contact us at info@decisionaltitude.co within 30 days of your purchase date and we will issue a full refund, no questions asked.
Refunds are processed by Paddle.com (our Merchant of Record) and will be returned to your original payment method within 5–10 business days depending on your bank or card provider. Refund requests received more than 30 days after the purchase date will not be processed.
For advisory sessions, refunds are available if cancelled at least 48 hours before the scheduled session. Sessions cancelled with less than 48 hours' notice may be charged in full. Advisory sessions are sold and invoiced independently from our digital products and are not processed through Paddle.
6. Payment
Payments for digital products are processed by Paddle.com (Paddle Payments Ltd), which acts as the Merchant of Record. Paddle handles payment processing, invoicing, applicable taxes, and refund administration for digital product purchases. We do not store your payment card details. 7. Intellectual Property
All content on this website and in our digital products, including text, graphics, frameworks, methodologies, guide materials, and design, is the intellectual property of Decision Altitude and is protected by copyright law.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or in any way exploit any of our content without prior written permission.
8. Limitation of Liability
Decision Altitude provides mentorship and guidance based on professional experience. We do not guarantee specific outcomes regarding your aviation career, training decisions, exam results, or employment prospects.
To the maximum extent permitted by law:
- Our total liability for any claim arising from our services is limited to the amount you paid for the specific service or product giving rise to the claim.
- We are not liable for indirect, incidental, consequential, or punitive damages.
- We are not liable for decisions you make based on our guidance, as all career and training decisions remain your responsibility.
9. User Conduct
You agree not to:
- Share, resell, or redistribute purchased digital content.
- Record advisory sessions without prior written consent.
- Provide false information during purchase or registration.
- Use our services or content for any unlawful purpose.
10. Modifications
We reserve the right to modify these Terms at any time. Changes become effective upon publication on this page. The "Last updated" date at the top reflects when the most recent changes were made. Continued use of our website or services after modifications constitutes acceptance of the updated Terms.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of Romania. For consumers residing in the EU, mandatory consumer protection provisions of your country of residence apply to the extent they provide a higher level of protection.
Any disputes shall be submitted to the competent courts of Romania, without prejudice to the consumer's right to bring proceedings in the courts of their place of residence.
